Al Ain dental implant lawsuit highlights crucial patient safety and medical liability issues after a medical centre and dentist were fined Dh100,000 for a botched dental implant procedure. The Al Ain Court for Civil, Commercial, and Administrative Claims ruled that the medical centre and the treating dentist are jointly liable for causing severe pain and complications to a patient following an error during implant surgery.
The patient initially sought Dh300,000 in compensation for physical, financial, and emotional distress resulting from a dental implant that displaced into the sinus cavity. This non-severe medical error involved inadequate assessment and care by the dentist, according to the Higher Committee for Medical Liability.
The court’s findings highlighted the dentist’s failure to properly evaluate implant stability and exercise sufficient caution during corrective surgery, leading to multiple follow-up operations under general anaesthesia to remove the displaced implant.
Despite the error not being classified as severe, the court acknowledged the significant suffering and long-term complications endured by the patient, ordering Dh100,000 in damages to be paid by both the clinic and the dentist.
