Dubai Custody Lawsuit

Court has dismissed a renewed Dubai custody lawsuit filed by a mother seeking to regain custody of her two sons and request additional financial support from her former husband. The court ruled the case inadmissible, affirming the finality of previous judgments that conclusively settled all custody and financial matters.

Presided over by Judge Majed Saif Mohammed Al Maamari of the Fourth Personal Status Circuit, the October 22, 2025 ruling closed a family dispute spanning nearly a decade. The court found the mother’s claims legally inadmissible because custody was transferred to the father in 2020 when the children exceeded maternal custody age under UAE law. This decision was upheld on appeal and by the Court of Cassation.

The mother’s new case, filed in August 2025, argued custody for the younger son and requested monthly maintenance of Dh10,000, Dh1,000 for internet and study costs, school fee coverage, a domestic helper, and a vehicle or cash equivalent. The defense cited repeated litigation and lack of standing, as the elder son, who turned 18 in June 2025, has legal capacity to represent himself.

The court confirmed the elder son’s legal majority and dismissed all claims related to him. Financial requests closely linked to custody were rejected due to no new evidence or change in circumstances. The plaintiff was ordered to pay court fees and Dh500 in legal costs, underscoring the principle that final judgments must be respected.
