Can Banks Use ILOE or Gratuity to Clear Outstanding Loans in the UAE?

The short answer is: yes — but it depends on your loan contract, and the bank isn’t automatically required to forgive or pause payments.

UAE Banks Using ILOE Loans – Gulf Repost

When you lose your job in the UAE, you may wonder whether your bank can tap into your unemployment support or end-of-service benefits to settle loans. The short answer is: yes — but it depends on your loan contract, and the bank isn’t automatically required to forgive or pause payments.

The federal unemployment insurance scheme, known as the Involuntary Loss of Employment (ILOE) benefit, provides up to 60% of your basic salary for a maximum of three months. However, banks are not obliged to apply these payments directly to loan balances unless specified in your loan agreement. In contrast, your end-of-service gratuity can be used by a lender if your employer deposits it into an account that’s pledged to the bank and if your contract includes that provision.

Legal experts say that many UAE banks include clauses in personal loan agreements allowing them to claim your gratuity or freeze it upon the crediting of your final settlement if you have an outstanding debt. The key safeguard for borrowers is to review the loan agreement carefully, understand whether any job-loss or Credit Shield insurance is in place, and proactively inform the bank of any change in employment. If you’re eligible for ILOE or you’ve submitted your claim, you should still communicate with your lender immediately and check whether you qualify for a restructuring programme or temporary relief under hardship policies.

Ultimately, while your ILOE benefits or gratuity can be used to reduce outstanding loans, it is neither a guaranteed tool for loan forgiveness nor a substitute for timely repayments. Stay in open dialogue with your bank, keep abreast of your rights and obligations, and approach your financial position proactively.
